29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures: (a) RME Ltd LLC, dba Rocky Mountain Excavating, at 1520 20th Street, Denver, CO: On 11/19/19, sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures. The employer was installing a water line perpendicular to the street direction. An excavation was dug through the concrete roadway and to a depth ranging from approximately 3.9 feet to 6.4 feet below grade. The concrete roadway was undermined by the excavation at the area of the excavation that was approximately 6.4 feet deep. Two employees performed work within the excavation. The employer had not provided a support system or other method to prevent a possible collapse of the concrete roadway. This condition exposed employees to a cave-in hazard.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 29 CFR 1926.652(c): (a) RME Ltd LLC, dba Rocky Mountain Excavating, at 1520 20th Street, Denver, CO: On 11/19/19, the employer did not ensure that each employee in an excavation was protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 29 CFR 1926.652(c). The employer was installing a water line perpendicular to the street direction. An excavation was dug through the concrete roadway and to the depth of existing utility pipes. One employee performed work in the north end of the trench which ranged in depth from 6.4 to 6.1 feet below grade. The competent person had classified the soil as Type C soil. The walls of the excavation were approximately vertical. The excavation did not utilize a shoring or shield system. The excavation was not sloped per Appendix B. The employer had not utilized a protective system for the excavation. This condition exposed employees to a cave-in hazard.
