29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, were not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart:  (a) RME Ltd., LLC DBA Elite Surface Infrastructure at 9345 E 56th Ave in Commerce City, CO: On or about September 28, 2022, employees were exposed to cave in hazards while working in a trench greater than 5 feet deep, with granular cohesionless Type B soil, without adequate sloping of the trench walls. The slope of the south wall was estimated to be 53 degrees, and the north wall was a near vertical cut. The employer had not complied with the provisions of 1926 Subpart P Appendix B in that the maximum allowable slope associated with Type B soil was an angle of 45 degrees.
