29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about 11/21/19 in the production area, the employer did not implement an effective hearing conservation program for: 1. An employee was exposed to noise levels of 66.8% of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 87.1 dBA during the 514 minute sampling period; exposure calculations included a zero increment for the 30 minutes not sampled. 2. An employee was exposed to noise levels of 92.3% of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 89.4 dBA during the 516 minute sampling period; exposure calculations included a zero increment for the 30 minutes not sampled. 3. An employee was exposed to noise levels of 91.9% of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 89.4 dBA during the 493 minute sampling period; exposure calculations included a zero increment for the minutes not sampled. 4. An employee was exposed to noise levels of 136.1 % of the permissible daily noise exposure (8-hour time-weighted average of 85 dBA) or an equivalent sound level of approximately 92.2 dBA during the 502 minutes sampling period: exposure calculations included a zero increment for the 30 minutes not sampled.
