OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards associated with improper automobile lift operations: (a) On or about November 21, 2019, and at times prior, TOAB, Inc. employees were exposed to crushing and struck-by hazards while working around automotive lifts as follows: 1- Lifts were not inspected annually by a qualified person in order to ensure safe operation. 2- Rotary Lift model: SMO12I020, SN: JGM02D0001 located in bay #6 had a broken hydraulic oil reservoir with visible signs of fluid leakage. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch: (a) On or about November 21, 2019, and at times prior, TOAB, Inc. did not ensure that the distance between the abrasive wheel periphery and the adjustable tongue at the top did not exceed 1/4" . Employees were exposed to struck-by hazards, in that a Jet 6" grinder was used while the tongue guard was not adjusted properly. The distance between the abrasive wheel and the tongue guard was 3/8". Abatement Note: Abatement certification is required for this item. (see enclosed "Certification of Corrective Action Worksheet").
