29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Agriculture Reference: 1928.21(a)(5))      a.  On or about November 19, 2019 and at times prior, the employer did not develop a written hazard communication program that described how criteria specified in 29 CFR 1910.1200 paragraph (f) for labeling, paragraph (g) for safety data sheets, and (h) for training would be met.  Employees work with hazardous chemicals including, but not limited to carbon dioxide (asphyxiant), hydrogen peroxide (oxidizer), denatured alcohol (flammable), and diesel fuel (flammable).

On or about November 19, 2019 and at times prior, the employer did not maintain in the workplace copies of the required safety data sheets for hazardous chemicals including, but not limited to carbon dioxide (asphyxiant) and diesel fuel (flammable) which were present in employee work areas.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Agriculture Reference: 1928.21(a)(5))      a.  On or about November 19, 2019 and at times prior, the employer did not provide information and training on hazardous chemicals.  Employees worked with hazardous chemicals including, but not limited to carbon dioxide (asphyxiant), hydrogen peroxide (oxidizer), denatured alcohol (flammable), and diesel fuel (flammable).
