29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at 3068 Avalon Road, Upper Arlington, Ohio: On or about November 25, 2019, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction while employees performed sheathing work onsite.  Four employees were unprotected from falls off the roof-top of the second floor level and off a high reach extended forklift.  The fall distance was approximately 24 feet to the ground level.  Employees were also exposed to  struck-by hazards while operating the pneumatic nail gun (Paslode, Model F350S).

Located at 13068 Avalon Road, Upper Arlington, Ohio: On or about November 25, 2019, the employer failed to ensure the use of eye protection, while two employees installed framing lumber and used the pneumatic nail gun (Paslode Model F350S).  The employees were exposed to a struck by hazard as a result.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.  a. Located at 3068 Avalon Road, Upper Arlington, Ohio: On or about November 25, 2019, the employer permitted an employee to work off a scaffold platform of a stack of OSB sheathing that was elevated off the forks by a Pettibone 8044, Rough Terrain Telescope Forklift, that was not approved by the manufacturer to lift personnel.  By permitting the employee to work off the platform, the employer exposed his employee to a fall hazard of approximately 24 feet to the ground level.

29 CFR 1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied.  a. Located at 3068 Avalon Road, Upper Arlington, Ohio: On or about November 25, 2019, the employer permitted an employee to work on a scaffold platform of a stack of OSB sheathing, that was supported by the Pettibone 8044 Rough Terrain Telescope Forklift.  The OSB sheathing was not secured to the forklift and therefore exposed the employee to a fall hazard of approximately 24 feet to the ground level.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a.  Located at 3068 Avalon Road, Upper Arlington, Ohio:  On or about November 26, 2019, the employer failed to ensure that the employees who worked on the roof top of the second floor of the new build residential home, were protected from falling off the unprotected side and edge.  The employees were exposed to a fall hazard of approximately 24 feet to the ground level.  b.  Located at 3068 Avalon Road, Upper Arlington, Ohio:  On or about November 26, 2019, the employer failed to ensure that the employee who worked off the Pettibone 8044, Rough Terrain Telescope Forklift, to transition OSB sheathing to the roof top of the second floor of the new build residential home, was protected from falling off the scaffold platform of OSB sheathing.  The employee was exposed to a fall hazard of approximately 24 feet, without any means of fall protection, to the ground level.
