29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Blues Roofing, LLC located at 4305 Woodbridge Road Upper Arlington, OH 43220:  On and preceding December 5, 2019, employees were performing roofing work on the roof of a one story residential home at heights up to 18 feet without fall protection or PPE. The employer did not initiate and maintain safety and health programs related to the roofing work being conducted.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Blues Roofing, LLC located at 4305 Woodbridge Road Upper Arlington, OH 43220:  On and preceding December 5, 2019, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize these hazards. Roofers were removing/installing shingles on a roof that varied from 10-18 feet with the employees using ladders and pneumatic nail guns. The employees were not utilizing eye or fall protection which exposed them to falls up to 18 feet and struck by hazards to the eyes.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Blues Roofing, LLC located at 4305 Woodbridge Road Upper Arlington, OH 43220:  On and preceding December 5, 2019, the employer did not ensure that employees wore eye protection while utilizing pneumatic nail guns. A worker was installing roofing shingles using a pneumatic nail gun powered at 90-120 psi without the use of eye protection.  The following condition exposed employees to struck-by hazards to the eyes.

Roofers were removing/installing shingles on a roof that varied from 10-18 feet without the use of proper fall protection which exposed them to falls up to 18 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Blues Roofing, LLC located at 4305 Woodbridge Road Upper Arlington, OH 43220:  On and preceding December 5, 2019, the employer did not ensure that the portable ladder used to gain access to the roof extended at least three feet beyond the upper landing that they were using for access.  One extension ladders used to gain access to roof on the side of the home was positioned 12 inches beyond the upper landing.  The following condition exposed employees to falls up to 10 feet.
