29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Blues Roofing, LLC located at 7171 Foder Rd, New Albany, OH 43054:  On or about April 25, 2013, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Roofers were removing/installing shingles on a roof that varied from 11-20 feet without the use of proper fall protection which exposed them to falls of over 20 feet.  Blues Roofing, LLC was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1448948, citation number 1, item number 4 and was affirmed as a final order on January 6, 2020, with respect to a workplace located at 4305 Woodbridge Road Upper Arlington, OH 43220.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Blues Roofing, LLC located at 7171 Foder Rd, New Albany, OH 43054:  On or about April 25, 2013, employees were performing roofing work on the roof of a  residential home at heights over 20 feet without fall protection or PPE. The employer did not initiate and maintain safety and health programs related to the roofing work being conducted.  Blues Roofing, LLC was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1448948, citation number 1, item number 1 and was affirmed as a final order on January 6, 2020, with respect to a workplace located at 4305 Woodbridge Road Upper Arlington, OH 43220.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Blues Roofing, LLC located at 7171 Foder Rd, New Albany, OH 43054:  On or about April 25, 2013, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize these hazards. Roofers were removing/installing shingles on a roof that varied from 11-20 feet with the employees using ladders and pneumatic nail guns. The employees were not utilizing eye or fall protection which exposed them to falls of over 20 feet and struck by hazards to the eyes.  Blues Roofing, LLC was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1448948, citation number 1, item number 2 and was affirmed as a final order on January 6, 2020, with respect to a workplace located at 4305 Woodbridge Road Upper Arlington, OH 43220.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Blues Roofing, LLC located at 7171 Foder Rd, New Albany, OH 43054:  On or about April 25, 2013 the employer did not ensure that employees wore eye protection while utilizing pneumatic nail guns. Roofers installing roofing shingles using pneumatic nail guns powered at 90 psi without the use of eye protection.  The following condition exposed employees to struck-by hazards to the eyes.  Blues Roofing, LLC was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1448948, citation number 1, item number 3 and was affirmed as a final order on January 6, 2020, with respect to a workplace located at 4305 Woodbridge Road Upper Arlington, OH 43220.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Blues Roofing, LLC located at 7171 Foder Rd, New Albany, OH 43054:  On or about April 25, 2013, the employer did not ensure that the portable ladder used to gain access to the roof extended at least three feet beyond the upper landing that they were using for access.  One extension ladder was used to gain access to roof on the side of the home was positioned 12 inches beyond the upper landing.  The following condition exposed employees to falls over 11 feet.  Blues Roofing, LLC was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1448948, citation number 1, item number 5 and was affirmed as a final order on January 6, 2020, with respect to a workplace located at 4305 Woodbridge Road Upper Arlington, OH 43220.
