OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees by exposing employees to struck-by hazards. a) Dock stations area/Warehouse - On or about December 3, 2019, the employer exposed employees to the struck-by hazards in that employer failed to ensure that employees were wearing a safety belt while operating LPG Toyota forklifts (Serial # 16543, Serial # 16597 & Model # 8FGCU18), (Serial # 16597 & Model # 8FGCU18) for loading and unloading the pallets contained bags of chemicals.

Materials or equipment were placed, either permanently or temporarily, within the exit route. a) Dock stations area/ Exit door - On or about December 3, 2019, and at times prior to, the employer exposed employees to fire hazards in that an exit rout was not kept free and unobstructed when employees were operating LPG forklift trucks to load and unload the pallets contained chemicals.

29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer: a) Warehouse - On or about December 3, 2019, and times prior to, the employer exposed employees to respiratory tract irritations in that the employer failed to establish and implement a written respiratory protection program in the facility when employees were required to wear the 3M 6003 half masks for chemical spills clean up while working with hazardous chemicals such as, but not limited to Specflex NF 1259 Polyol and Specflex NE 357 Isocyanate.
