29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: guardrail systems, safety net systems, or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. Locomotive roof, Engine house, 38 Railroad Yard Road, Deerfield, MA: On or about December 9, 2019 employees were observed performing maintenance to engine exhaust stacks which had unprotected sides and edges more than 10 feet above the next lower level (locomotive deck) and were not protected from falling by either standard guard rail systems, safety nets systems or personal fall arrest systems.

29 CFR 1910.28(b)(5)(i): The employer did not ensure each employee on a runway or similar walkway was protected from falling 4 feet (1.2 m) or more to a lower level by a guardrail system. Catwalk Track 4, Engine house, 38 Railroad Yard Road, Deerfield, MA: On or about December 9, 2019 employees were observed using a catwalk to access the roof of a locomotive which did not have a complete guardrail system on both sides which had unprotected sides and edges more than 4 feet above the next lower level. The side of the catwalk located closet to the repair track had a top rail (chain), but did not have a mid-rail. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).

Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).
