In the event of a flash fire or deflagration the employee was exposed to thermal burns on or about 12/20/19.

29 CFR 1910.138(a): The employer did not select and require employees to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasion; punctures; chemical burns; thermal burns; and harmful temperature extremes. (a) 219 Lafayette Street: The knife fitter employee was exposed to lacerations when installing and maintaining knives in machines but was not provided hand protection rated for cut resistance, exposing the employee to lacerations on or about 12/20/19. (b) 219 Lafayette Street: Employees collected wire scraps, pieces of metal, and maintained equipment in the facility without having been provided hand protection rated for cut resistance, exposing the employees to lacerations on or about 12/20/19.

29 CFR 1910.1200(h)(3)(ii): Employee training did not include the physical and health hazards of the chemicals in the work area: (a) 219 Lafayette Street: Workers operated and cleaned around machines that shredded, granulated and screened bales of insulated copper wire to obtain the copper. Combustible dust was generated and pneumatically collected from the processes, but fugitive dusts settled in Area D, therefore workers swept the area. Workers periodically changed the filter bags in the Donaldson Torit Baghouse. Effective Hazard Communication training was not provided to all employees who work with or around the hazardous chemicals in that employees were not informed that the dust was combustible, on or about 12/20/19.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms, service rooms, and walking-working surfaces were not kept in a clean, orderly, and sanitary condition. (a) Lunch Room: The lunch room used by employees was not kept in a clean and sanitary condition, on or about 12/12/2019. (b) Area D: The employer did not ensure housekeeping sufficient to prevent the accumulation of combustible dust at depths of greater than 1/32 of an inch on tops of ducts, beams, ledges, and equipment in the area which housed the ducts that lead from process machinery, such as screeners, to the Donaldson Torit Dust Collector on or about 3/19/20.
