29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about 12/6/2019 at the intersection of Peachtree Industrial Boulevard and Pleasant Hill Drive Duluth, GA where the employer failed to protect workers from cave-in and caught-in hazards where the Type B soil, sheer seven-foot face and 16-feet of hill above the trench excavation was not protected from collapse. CMES, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1059174, citation number 2, item number 1 and was affirmed as a final order on 11/17/2016, with respect to a workplace located at 2691 Windy Hill Road SE, Marietta, GA 30067.
