29 CFR  1926.652(d)(2):Manufactured materials and equipment used for protective systems were not used and maintained in a manner that would have prevented employee exposure to hazards:  RockMill Road & Kimball Bridge Road, Alpharetta, GA 30022, Excavation on east bound side of the roadway: On or about 09/03/2020, adequate cave-in protection was not provided to/for employees engaged in trenching activities. The employer failed to ensure that the trench shield used for cave-in protection were erected according to the manufacturer's requirements, and thus exposed an employee who was working inside of a 6-foot deep excavation to hazards created by cave-ins and/or collapses. The cave-in protection was missing two of the owner horizontal struts and the space between the walls of the soil and the trench box were not kept tight to prevent the walls of shoring box from failing.

29 CFR 1926.652(g)(1)(iii): Employees were not protected from the hazard of cave-ins when entering or exiting the area protected by shields:  Rockmill Road & Kimball Bridge Road, Alpharetta, GA 30022, Excavation on east bound side of the roadway: On or about 09/03/2020,  the employer exposed employees to engulfment hazards while installing 24-inch storm drain pipe, in that the ladder used for egress from the excavation was located outside the trench shield being used. The employer failed to place the ladder inside the protective system to allow for safe egress.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:   Rockmill Road & Kimball Bridge Road, Alpharetta, GA 30022, Excavation on east bound side of the roadway: On or about 09/03/2020, the employer exposed employees to collapse/fall hazards of up to 6-feet, in that a ladder(s) with damaged components was provided for and used by employees to access and/or egress an excavation. The Werner 12 feet base section of a 24-ft. ladder had bent rungs, and split fiberglass rails on the right base side of the ladder. The ladder was not removed from service by the foreman or competent person on site.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  RockMill Road & Kimball Bridge Road, Alpharetta, GA 30022, Excavation on east bound side of the roadway: On or about 09/03/2020,  the employer exposed  an employee to cave-in hazards, in that a cave-in protection system was not used within the excavation while installing 24-inch storm drainage pipes in an excavation that was 9-feet wide x 8-feet deep x 89 feet long.  Construction Management & Engineering Services, Inc. DBA CMES  Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number #1144527, citation number 1, item number 1 and was affirmed as a final order on 10/06/2016, with respect to a workplace located at 2360 Windy Hill Road, Marietta, GA 30060.
