29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:   The employer is failing to ensure that the eyes and face of employees are protected from flying particles while erecting wood frame components for a newly constructed house.  This most recently occurred on January 9, 2020 on the jobsite located at 10036 Fieldcrest Dr., Omaha, NE 68114.  Employees were observed using a hand-held circular saw and pneumatic nail guns without any form of eye or face protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:   The employer is failing to ensure that all employees exposed to fall hazards while working on a residential roof are utilizing fall protection.  This most recently occurred on January 9, 2020 on the jobsite located at 10036 Fieldcrest Dr., Omaha, NE 68114.  The owner had 8 employees installing shingles on an existing 2-story duplex house without any form fall protection.  Height from the ground to the edge of the roof is approximately 9.5 feet and the roof has an 8 in 12 pitch.      Angel Rodriguez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1357171, citation number 1, item number 1, and was affirmed as a final order on February 27, 2019 with respect to a workplace located at 2509 S. 186th Cir, Omaha, NE 68130.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   The employer is failing to ensure that all employees are protected from fall hazards when entering and exiting the landing surface of a residential roof.  This most recently occurred on January 9, 2020 on the jobsite located at 10036 Fieldcrest Dr., Omaha, NE 68114.  Employees are using an aluminum extension ladder to enter and exit the roof where the side rails were not extended to at least 3 feet above the landing surface which is about 9.5 feet above the ground.       Angel Rodriguez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1357171, citation number 1, item number 2, and was affirmed as a final order on February 27, 2019 with respect to a workplace located at 2509 S. 186th Cir, Omaha, NE 68130.
