29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) On or about 01/07/20, at an excavation in the Genesee Valley Regional Market, located on 900 Jefferson Road in Rochester, New York, the employer did not protect employees working in a trench more than 5 feet in depth (7 ft.) from cave-in hazards. The use of sloping, or benching or the use of support and shield systems were not in use. NO ABATEMENT CERTIFICATION REQUIRED
