OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck by and or struck against injuries while working in a scissor lift not properly inspected or maintained to ensure the control panel was secured: a) On or about 06/09/2023, during the construction of the new Chipolte Mexican Grill, located on 2735 Monroe Avenue, in Rochester, New York, the employer did not enforce operator safety practices for employees working from a scissor lift (SkyJack SJ111 3219). Employees were allowed to operate a scissor lift without performing a visual inspection of the lift and without reading the operating manual as required by the manufacturer. Employees were exposed to struck by and or struck against hazards due to an unsecured control console, which was not secured in place with the provided locking pin. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about 06/09/2023, during the construction of the new Chipolte Mexican Grill, located on 2735 Monroe Avenue, in Rochester, New York, the employer did not enforce the use of fall protection when employees were constructing the building framework. Employees were allowed to work along unprotected sides, 14 feet above lower levels, without fall protection and were exposed to fall hazards. NO ABATEMENT CERTIFICATION REQUIRED
