29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.   At the construction site, the employer did not ensure that employees were wearing hardhats while working below other employees. Employees were exposed to a struck-by hazard from falling objects.

29 CFR 1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladder length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  At the residential construction site, employees accessing the roof on a metal ladder with side rails that did not extend at least 3 feet above the edge of the roof were potentially exposed to fall hazard greater than 10 feet.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.   At the construction site, the employer did not ensure that employees using a nail gun for roofing activities were provided eye protection.  Employees were exposed to being struck by flying objects.   Francisco Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1047150, Citation Number 1, Item number 1, and was affirmed as a final order on May 29, 2015, with respect to a workplace located at  828 Trailwood Dr. Desoto, Texas 75115.
