29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  At the time of the inspection, it was determined that on 1/14/2020 the guarding on the dust collector hopper rotary valve was inadequate to prevent an employee from reaching into rotating parts and causing an amputation injury.

29 CFR 1910.1000(c): 29 CFR 1910.1000(c):  Employees were exposed to total nuisance dust, listed in Table Z-3, in excess of 15mg/m3 as an 8 hour Time Weighted Average concentration:  At the time of the inspection, employee sampled for total nuisance dust on 1/23/2020 for 424 minutes received an eight hour time weighted average exposure of 20.0mg/M3 with time less than 8 hours counted as zero exposure.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  At the time of the inspection, the employer had not evaluated employee exposure to nuisance dust in the new tree spike production line. OSHA sampling found exposures to nuisance duct above the Permissible Exposure Limit and exposed employees were not protected with an adequate respiratory protection program.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  At the time of the inspection, employees in the Distribution Center Lines 1 & 2 were voluntarily wearing disposable dust mask and had not been trained in the requirements of Appendix D of this section.
