29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.  On January 23, 2020, located throughout a commercial exterior structure, the employer failed to provide a competent person to supervise and direct during the installation of plastic used as a windscreen on the scaffold system that altered the scaffold on how the loads imposed by a plastic enclosure can affect the structural integrity of the scaffold system.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  a) The nature of any electrical hazards, fall hazards and falling object hazards in the work area;    b) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used;     c) The proper use of the scaffold, and the proper handling of materials on the scaffold;      d) The maximum intended load and the load-carrying capacities of the scaffolds used; and      e) Any other pertinent requirements of this subpart.   On January 23, 2020, located throughout a commercial exterior structure, employees were working from tubular welded frame scaffold system in that the employer did not provide scaffolding training to employees to recognize the hazards associated with the type of scaffold used and to understand the procedures to control or minimize those hazards. Potential fall height measured to be greater than 25 feet.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  On January 23, 2020, located on the west side of a commercial structure, an employee installing plastic to the scaffolding system exposed to a fall hazard sitting on the cross brace of a tubular welded frame scaffold system. Potential fall height measured to be greater than 25 feet.  The TDR Interiors Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 1102827, citation number 1, item number 2 and was affirmed as a final order on 11/25/2015, with respect to a workplace located at 7691 Montgomery Rd., Cincinnati, OH 45236.
