29 CFR 1910.1200(f)(6)(ii): Workplace labeling. Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with product identifier and words, pictures, symbols, or combination thereof which provide at least general information regarding the hazards of the chemicals. On or about January 23, 2020, the employer did not ensure that barrels of chemicals used to clean vehicles were labeled, tagged or marked with product identifier and words, pictures, symbols, or combination thereof. The plastic barrels contained a mixture of chemicals such as Potassium Hydroxide and surfactants, which the employees would spray onto vehicles to clean before and after repairs were made.

29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means shall be fully lowered, controls shall be neutralized, power shall be shut off, and brakes set. Wheels shall be blocked if the truck is parked on an incline. On or about January 23, 2020, the Harlo HP8500 forklift serial number 90700 did not have the load engaging mean fully lowered. The unattended forklift had the forks raised approximately three feet off the ground, the controls in neutral positions, the power shut off, and the brakes set while parked on a flat surface outside of the building.
