29 CFR 1926.502(d)(21): Personal fall arrest systems were not inspected prior to each use for wear, damage, and other deterioration, and defective components were not removed from service: (a) Top Level - Employees connected steel on the top of the tower section of the building, eleven stories above the ground. The employees used personal fall arrest systems, which included, Ultra-Safe Harnesses, Ultra-Safe double-leg retractable lanyards, and wire rope cables (a.k.a. pin cables) to anchor to beams. Defective components did not get removed from service, as follows, exposing employees to fall hazards, on or about January 22, 2020: - The labeling on an Ultra-Safe double-leg retractable lanyard, model M2-HPSY8Y, serial number 071718-019A, had become illegible due to wear; - An Ultra-Safe double-leg retractable lanyard had none of the information, including, but not limited to, model number, serial number, and length, recorded on the blank spaces provided on the retractables' labeling for this information; and - Wire rope (pin) cables either had no labeling or only had rigging labeling (applicable for using the wire rope as a lifting sling but not as a component of a personal fall arrest system). Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
