29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  On or about January 27, 2020, and at times prior thereto, employees were exposed to undue physiological stress when wearing respirators while working with nitric and hydrochloric acid without a written respiratory protection program that covers elements such as, but not limited to, respirator selection, medical evaluation of employees, fit testing of employees, and training.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:  a) Production area: On or about January 27, 2020, and at times prior thereto, employees were exposed to chemical hazards from a container containing nitric acid that was not labeled to identify the product and hazards associated with it.  b) Production area:  On or about January 27, 2020, and at times prior thereto, employees were exposed to chemical hazards from a container containing sulfuric acid that was not labeled to identify the product and hazards associated with it.  c) Production area:  On or about January 27, 2020, and at times prior thereto, employees were exposed to chemical hazards from a container containing hydrochloric acid that was not labeled to identify the product and hazards associated with it.  d) Bulk storage area:  On or about January 27, 2020, and at times prior thereto, employees were exposed to chemical hazards from a measuring cup containing hydrochloric acid that was not labeled to identify the product and hazards associated with it.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used:  Lab area: On or about February 4, 2020, and at times prior thereto, employees were exposed to a fire hazard while storing flammable chemicals such as, but not limited to, Briteguard CB-29 with oxidizing agents such as, but not limited to, Magnesium Dioxide together.
