29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On or about January 28, 2020, the employer failed to provide frequent and regular job site inspections by a competent person to prevent hazards such as but not limited to, a 14 foot 7 inch fall hazard from a commercial construction roof top.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access. a.) On or about January 28, 2020, an employee was exposed to a 14 foot 7 inch fall hazard on a tubular welded steel frame scaffold system. The employee used the end frame section of the scaffold system to egress a commercial construction roof top. The end frame did not contain an integrated prefabricated scaffold access nor was there any other form of ladder available for use.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a.) On or about January 28, 2020, employees were exposed to a 14 foot 7 inch fall hazard while performing masonry work on the roof of a commercial car wash. The employees were not protected from falling to the lower level by any means of conventional fall protection.
