Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On or about December 12, 2022, the employer did not ensure that a frequent and regular inspection program was being maintained and used by a competent person of the job site, material and equipment; as a result employees were exposed to a fall hazard of 11.8 ft. without utilizing a fall protection system and employees were not being trained to use powered industrial vehicles.

29 CFR 1926.453(b)(2)(iv): Aerial lifts. Specific requirements. Extensible and articulating boom platforms. Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position. a) On or about December 12, 2022 the employer did not ensure employees remain standing on the floor of the basket while working. Employees were exposed to a 11.8 ft. fall hazard while operating an articulating boom platform to frame the front of a commercial building, after detaching from the lanyard and climbing the railing of the basket to reach the work being performed.
