29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. The employer had not conducted frequent and regular inspections of the jobsite where at 9149 Cincinnati Columbus Road, West Chester on January 29, 2020, an employee was exposed to a 17 ft. fall hazard while working on a low slope roof of a one story commercial building.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On January 29, 2020, at 9149 Cincinnati Columbus Road, West Chester, a one-story commercial building, an employee was exposed to a 17 ft. fall hazard while working with the subcontractor employees to join 10 ft. gutter sections on the flat metal roof after about 1/3 of the gutter work had been completed without utilizing any fall protection.

The employer had not provided fall protection training that went over Subpart M, Fall Protection, specifically when fall protection standard applied and required fall protection based on the type of work being performed in that on January 29, 2020, an employee went up on the flat metal roof after the gutter work had started was about 1/3 completed and was not utilizing any fall protection and was exposed to a 17 ft. fall hazard.
