29 CFR 1926.651(g)(1)(ii): Adequate precautions were not taken to prevent employee exposure to atmospheres containing less than 19.5 percent oxygen and other hazardous atmospheres: a) On January 28, 2020, employees engaged in torch cutting operations while working inside of the trench measuring approximately 9 feet in depth were not provided with adequate precautions including atmospheric testing or ventilation were oxygen deficiency or a hazardous atmosphere existed or could have reasonably been expected to exist. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
