29 CFR 1926.651(g)(1)(i): Where oxygen deficiency (atmosphere containing less than 19.5 percent oxygen) or a hazardous atmosphere existed or could reasonably be expected to exist, such as in excavations in landfill areas or excavations in areas where hazardous substances are stored nearby, the atmospheres in the excavation were not tested before employees entered excavations greater than 4 feet (1.22m) in depth: On or about January 30, 2020, an employee engaged in excavation operations was exposed to a respiratory hazards due to the employer not testing the atmosphere prior to using a portable gas tamper inside trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On January 30, 2020, employees engaged in excavation operation were exposed to cave-in hazards due to the employer not following the tabulated data maximum horizontal spacing. Spiess Construction Company Inc. was previously cited for a violation of this occupational safety and health standard 1926.652(a)(1), which was contained in OSHA inspection number 1230377, citation number 01, item number 001 and was affirmed as a final order on October 20, 2020, with respect to a workplace located at Nacogdoches &Loop 1604, San Antonio, TX 78219.
