This was demonstrated on January 29, 2020 and at times prior when an unprotected side or edge was located in the third floor mezzanine. The employer failed to ensure that employees were not exposed to fall hazards greater than 4 feet by installing protective systems or use of personal fall protection.

29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates or markings were maintained in a legible condition:    At a worksite located at 17562 Gum Rd, Carthage, MO: Employees were exposed to struck-by, caught under, and crushing hazards. The employer failed to ensure that all markings on powered industrial trucks, including nameplates were kept legible prior to use.     a) This was demonstrated on January 28, 2020 when a Toyota power industrial truck (Serial No. 35459) in the Chub Emulsion was missing the control labels for the operating hydraulics that move the forks left and right.     b) This was demonstrated on January 28, 2020 when a Clark powered industrial truck (Fork-032) in the Chub Emulsion had a nameplate that was no longer legible.     c) This was demonstrated on January 28, 2020 when a Nissan powered industrial truck (Fork-029) in the Chub Emulsion had a nameplate that was no longer legible.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:    At a worksite located at 17562 Gum Rd, Carthage, MO: Employees were exposed to toxic and/or hazardous substances. The employer failed to ensure that all containers at the facility were properly labeled as to its contents.    c) This was demonstrated on January 29, 2020 when a large hopper (U-005) outside of Chub Emulsion was missing an identifying label. The contents of the hopper were identified as Ammonium Nitrate.      d) This was demonstrated on January 29, 2020 when a large tanks (TK-1100) located in the Oxidizer Tank Farm area had a label that was no longer identifiable. The contents of the tank were identified as Oxidizer Storage (Raw AN & Oxidizer).    f) This was demonstrated on January 29, 2020 when a large tanks (TK-400) located in the Oxidizer Tank Farm area had a label that was no longer identifiable. The contents of the tank were identified as SN Reactor (46% HNO3, Sodium Nitrate Urea, Sodium Carbonate, & Raw AN).

At a worksite located at 17562 Gum Rd, Carthage, MO: Employees were exposed to fire and explosion hazards. The employer failed to protect employees in that the Piping and Instrumentation Diagram (PIDC-CPPR-3148-11) developed for the system is not accurate, complete, and up-to-date for the covered process equipment associated with the synthesis of various chemical products using AN and SN prills, K37, and 7019 as the reagents associated with the Chub Dry Ingredient Transfer process equipment.    a) P&ID was not accurate for as a hopper labeled FD-002 was misidentified when the legend identifies that same hopper as F-002.
