29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:  a)  On or about February 4, 2020, the employer did not ensure when an employee went on top of the Pangborn GN Rotoblast Barrel Tumbler to unclog accumulated metal grit from the machine, the employee was protected from an approximate six (6) feet, five (5) inch fall hazard by a guardrail system, safety net system, or a personal fall arrest system.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a) On or about February 11, 2020, in the warehouse, the employer did not ensure an energy control program consisting of an energy control procedure, employee training and periodic inspections was established for employees performing service and maintenance on machines including, but not limited to, Pangborn GN Rotoblast Barrel Tumbler and its associated equipment.  Employees are required to unclog accumulated metal grit from the machine and its associated equipment without deenergizing and locking out the equipment.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics was not provided to the operator when the operator was involved in an accident or near-miss incident:  a)  On or about November 22, 2019, in the warehouse, the employer did not ensure a forklift operator received refresher training after being involved in an accident and before being allowed to re-operate a forklift.  An employee was injured after the forklift operator bumped a pallet that contacted the employee, which subsequently caused the employee to strike their right knee into a table.
