Employees were exposed to multiple fall hazards of up to 20 feet and struck-by hazards while conducting framing work.

Darwin Mendoza DBA Mendoza Construction was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1376152, citation number 1, item number 1 and was affirmed as a final order on May 25, 2019 with respect to a workplace located at Lakes At Cheshire Condos, Cheshire Road, Delaware, OH 43015.

Framers were installing lumber while using a pneumatic nail gun and a circular saw to cut the pieces. The employees were not utilizing eye protection, which exposed them to struck by hazards to the eyes. Darwin Mendoza DBA Mendoza Construction was previously cited for a Repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1376152, citation number 2, item number 1 and was affirmed as a final order on May 25, 2019 with respect to a workplace located at Lakes At Cheshire Condos, Cheshire Road, Delaware, OH 43015. Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) Darwin Mendoza DBA Mendoza Construction, at a worksite located at 832-836 Summerlin lane, Marysville, Ohio, 43040: On and/or preceding February 3, 2020, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were installing sheathing to the roof trusses while working 20 feet above the ground below. The employees were not utilizing any form of fall protection, which exposed them to falls up to 20 feet. Darwin Mendoza DBA Mendoza Construction was previously cited for a Repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1376152, citation number 2, item number 2 and was affirmed as a final order on May 25, 2019 with respect to a workplace located at Lakes At Cheshire Condos, Cheshire Road, Delaware, OH 43015.
