29 CFR  1926.1053(b)(13):The top or top step of a stepladder shall not be used as a step.  a) Mendoza Construction Company LLC, at a worksite located at 1020 River Road, Granville, Ohio 43023: On and/or preceding August 21, 2022, the employer failed to ensure employees did not use the top or top step of a step ladder. Employees used a step ladder to access the second story, while stepping on the top and top step of the ladder, thereby exposing the employees to a 6-foot fall hazard.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Mendoza Construction Company LLC, at a worksite located at 1020 River Road, Granville, Ohio 43023: On and/or preceding August 21, 2022, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Framers were installing lumber while using a pneumatic nail gun and a circular saw to cut the pieces. The employees were not utilizing eye protection, which exposed them to struck by hazards to the eyes.   Darwin Mendoza DBA Mendoza Construction Company LLC was previously cited for a Repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1461068, citation number 2, item number 2 and was affirmed as a final order on June 2, 2020, with respect to a workplace located at 832-836 Summerlin Lane, Marysville, OH 43040.  Darwin Mendoza DBA Mendoza Construction was previously cited for a Repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1376152, citation number 2, item number 1 and was affirmed as a final order on May 25, 2019 with respect to a workplace located at Lakes At Cheshire Condos, Cheshire Road, Delaware, OH 43015.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Mendoza Construction Company LLC, at a worksite located at 1020 River Road, Granville, Ohio 43023: On and/or preceding August 21, 2022, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were installing roof trusses while working 11 feet 9 inches above the ground below. The employees were not utilizing any form of fall protection and were exposed to falls up to 11 feet 9 inches.
