OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to ejection and crushing hazards while operating a forklift without wearing a seatbelt. a) On or about February 6, 2020, at the Oven Area on the front of the facility, employees were exposed to crush-by hazard while operating a forklift truck (Toyota Forklift serial # unknown) without utilizing the safety belt provided by the manufacturer.

29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels : a) On or about February 6, 2020, at the mill across the street from the office building, an employee was operating a Scragg Saw at the hearing conservation level of 92.6 dBA during a 414 minute sampling period without an annual audiogram. b) On or about February 6, 2020, at the north section of the mill near the dryers, an employee was operating a Viking Turbo Nailer/braider machine at the hearing conservation level of 89.4 dBA during a 414 minute sampling period without an annual audiogram. c) On or about February 6, 2020, at the mill across the street from the office building, an employee was observed operating Brewco Mill at the hearing conservation level of 96.18 dBA and at the Permissible Exposure Level of 96.04 dBA during a 414 minute sampling period without an annual audiogram
