29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)   On or about February 6, 2020 and at times prior thereto, the employer did not initiate and maintain a safety program that included frequent and periodic inspections of the job site where employees were performing installation of gypsum concrete and waterproofing on unprotected stairwell landings and second and third floor balconies at a new apartment building under construction.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about February 6, 2020 and at times prior thereto, the employer did not ensure a crew performing installation of gypsum concrete and waterproofing on balconies at a new apartment building under construction were protected from fall hazards:  a) employees accessed upper levels of the apartment complex by unprotected stairwells landings; and b) employees working from second and third floor unguarded balconies were not wearing personal fall protection systems.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about February 6, 2020 and at times prior thereto, the employer did not provide a fall protection training program to ensure employees understood and recognize fall hazards.  Employees performing installation of gypsum concrete and waterproofing on balconies and landings at a new apartment building under construction were not protected from recognized fall hazards.

On or about February 6, 2020 and at times prior thereto, the employer did not provide and verify by a written certification employees had conducted fall protection training to ensure employees understood, recognized and knew how to eliminate fall hazards.
