29 CFR 1926.1053(b)(1): A portable ladder used for access to an upper landing surface did not have the ladder side rails extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, was not provided to assist employees in mounting and dismounting the ladder. On or about February 7, 2020, at an excavation site located at 1501 S. Morgan Road in Oklahoma City, OK, the employer did not ensure that the side rails of the ladder, used by employees to access and exit the trench, extended at least three (3) feet above the landing of a trench, exposing the employees to fall hazards.
