29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  a.  On or about February 10, 2020, at the above addressed jobsite, the competent person onsite allowed employees to go into a trench that did not have a complete protective system, thereby exposing the employees to cave-in hazards.

29 CFR 1926.652(c)(3)(iii): At least one copy of the tabulated data, which identifies the registered professional engineer who approved the data, shall be maintained at the jobsite during construction of the protective system. After that time the data may be stored off the jobsite, but a copy of the data shall be made available to the Secretary upon request.  a.  On or about February 10, 2020, at the above addressed jobsite, employees were performing a sewer clean out to the main sewer line in a trench measured at eight (8) feet one (1) inches in depth.  The employer did not have or provide a copy of the tabulated data at the jobsite during construction of the protective system.

29 CFR 1926.701(b): Reinforcing steel. All protruding reinforcing steel, onto and into which employees could fall, was not guarded to eliminate the hazard of impalement.    a.  On or about February 10, 2020 at the above addressed jobsite, employees working in a trench were standing on and using  a concrete foundation for access and egress on the north side of the trench. The employees were exposed to ends of rebar that were not guarded, thereby exposing employees to the hazards associated with impalement.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:    The employer does not provide a stairway, ladder, ramp or other safe means of egress to each employee when working in a trench approximately 8' 1" deep.     a)  This most recently occurred on March 29, 2016, at 2346 West Grand Avenue, Chicago, Illinois.  An employee was not provided with a safe means of egress when working in a trench approximately 8' 1" deep.    To abate this hazard in the future, the employer must ensure that safe means of access and egress is provided to employees when working in the trench, and that no employees enter the trench until the safe means of access/egress is provided.  OG Plumbing LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1135828, citation number 2, item number 1 and was affirmed as a final order on October 21, 2016, with respect to a workplace located at 1035 Randolph St., Oak Park, IL 60302.  OG Plumbing LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1135519, citation number 2, item number 1 and was affirmed as a final order on October 21, 2016, with respect to a workplace located at 1036 Washington Blvd., Oak Park, IL 60302.    OG Plumbing LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 962359, citation number 2, item number 1 and was affirmed as a final order on July 23, 2014, with respect to a workplace located at 3624 N. Janssen Ave., Chicago, IL 60613.  OG Plumbing LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 767522, citation number 1, item number 1 and was affirmed as a final order on January 31, 2013, with respect to a workplace located at N. Damen Ave. & W. Erie St., Chicago, IL 60622.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect it's employees so that a safe means of access/egress is provided while working in excavations.

29 CFR 1926.652(a)(1):  Each employee in an excavation is not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):     The employer does not protect each employee in its excavations by properly sloping the excavation or by using appropriate protective systems designed in accordance with paragraphs (b) or (c) of 29 CFR 1926.652.       a)  This most recently occurred on February 10, 2020, at 2346 West Grand Avenue, Chicago, Illinois.  Employees were exposed to cave-in hazards while performing a sewer clean out to a main sewer line in a trench without the proper cave-in protection that was approximately 8' 1" in depth.
