29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:    (a)    MMBC, Inc. at 10191 Yampa Ct., Commerce City, CO 80022:  On and before January 27, 2020, the exposing employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system in that employees were engaged in framing work on the 2nd level of a new single family residential home under construction while being exposed to fall hazards associated with external floor edges and stair well opening. This condition exposed employees to fall hazards of approximately 10-11 feet.    (b)    MMBC, Inc. at 10213 Yampa Ct., Commerce City, CO 80022:  On and before January 27, 2020, the exposing employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system in that employees were engaged in framing work on the 2nd level of a new single family residential home under construction while being exposed to fall hazards associated with a stair well opening. This condition exposed employees to fall hazards of approximately 10-11 feet.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with one handrail and one stair rail system along each unprotected side or edge:    (a)   MMBC, Inc. at 10191 Yampa Ct., Commerce City, CO 80022:  On and before January 27, 2020, the exposing employer did not ensure that the interior stairway inside the building under construction being used by employees to gain access to the second level, rising approximately 10 feet, was equipped with an adequate stair rail system. This condition exposed employees utilizing the stairs to fall hazards of approximately 6-10 feet.      (b)   MMBC, Inc. at 10213 Yampa Ct., Commerce City, CO 80022:  On and before January 27, 2020, the exposing employer did not ensure that the interior stairway inside the building under construction being used by employees to gain access to the second level, rising approximately 10 feet, was equipped with an adequate stair rail system. This condition exposed employees utilizing the stairs to fall hazards of approximately 6-10 feet.

29 CFR 1910.178(l)(6):  The employer did not certify that each operator has been trained and evaluated in the safe operation of the forklifts in the workplace:    (a)            MMBC, Inc. at 10191 Yampa Ct., Commerce City, CO 80022:  On and before January 18, 2020, the exposing employer did not certify that the forklift operator had been trained and evaluated as required by 29 CFR 1910.178(l) in the topics as outlined in 29 CFR 1910.178(l)(3).    Note: The requirements applicable to construction work under paragraph 29 CFR 1926.602(d) are identical to those set forth in 1910.178(l).
