29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    Copper line and tin lines, Tricab (USA) Inc., 15 Coppage Dr, Worcester MA:  On 2/28/20, a machine operator was exposed to 173% of the action level (AL) for noise, which is equivalent to 93.9 dBA as a 12-hour time-weighted average (TWA), and the employer did not administer a continuing, effective hearing conservation program.  Sampling was conducted for 716 minutes, and the AL adjustment for 12-hour shifts for a 50% dose is 82.1 dBA.

(b)  Copper line:  On or about 2/11/20, the rodbreaker, which contained hazardous materials such as, but not limited to, Soluble Oil Conditioner No. 200G, which contains hexahydro-1,3,5-tris (2-hydroxyethyl)-s-triazine, was not labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals.    (c)  Tin lines:  On or about 2/11/20, the tin line tanks, which contained hazardous materials such as, but not limited to, sulfuric acid, were not labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals.
