29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about February 11, 2020, at an excavation site located at 7th and Cemetery Road in Yukon, OK, no protective devices were in place to protect an employee working in a trench greater than 5 feet in depth, exposing the employee to the hazard of being crushed by falling soil.

29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart. On or about February 11, 2020, at an excavation site located at 7th and Cemetery Road in Yukon, OK, an employee was allowed to work in a trench with the initial step elevated more than 4 feet above the trench floor, exposing the employee to the hazard of being crushed by falling soil.
