29 CFR 1910.22(c): (c) Access and egress. The employer must provide, and ensure each employee uses, a safe means of access and egress to and from walking-working surfaces. Employees were not provided with a safe means of access and egress while using the ship stairs to access a maintenance area on the mezzanine above the flammable storage area.

29 CFR 1910.22(d)(1): (1) Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition. The Toro Company did not conduct regular inspections of their walking-working surfaces which would have revealed damage to a set of ship stairs used by employees to access a maintenance mezzanine above the flammable storage area.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: guardrail systems, safety net systems or personal fall protection systems. Employees of The Toro Company who need to work from the maintenance mezzanine above the flammable storage were not protected from falls of nine feet when a section of guardrail was missing or had been removed.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years. On or about February 24, 2020, The Toro Company had not ensured that each Powered Industrial Vehicle operator had been re-evaluated every three years to ensure they retrained the skills necessary to ensure that safe operation of the Powered Industrial Vehicles.
