29 CFR 1910.1053(d)(3)(iv): Where the most recent exposure monitoring indicates that employee exposures are above the PEL, the employer shall repeat such monitoring within three months of the most recent monitoring. a. On or about February 27, 2020 for the Long Ridge Energy Terminal, Hannibal, Ohio worksite: the failed to perform repeat monitoring within three months of the most recent monitoring when exposure assessment personal employee exposure monitoring results were above the permissible exposure limit for respirable crystalline silica. On October 9, 2018, two employees were monitored while performing truck loading duties in the silo bulk truck loading area of the sand plant. Those employee exposure levels in excess of the permissible exposure limit by 8.6 times and 3.8 times the OSHA permissible exposure limit of 50 micrograms per cubic meter air. Silicosis and lung cancer are diseases associated with the inhalation of respirable crystalline silica.

29 CFR 1910.1053(d)(6)(i): Employee notification of assessment results. Within 15 working days after completing an exposure assessment in accordance with paragraph (d) of this section, the employer shall individually notify each affected employee in writing of the results of that assessment or post the results in an appropriate location accessible to all affected employees. a. On or about February 27, 2020, for the Long Ridge Energy Terminal, Hannibal, Ohio worksite: the employer failed to provide written notification of air monitoring results for October 9, 2019 respirable crystalline silica employee exposure assessments.
