OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each employee employment and a place of employment which was free from recognized hazards, which were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards while operating a crane. On or about March 2, 2020: a. an employee was exposed to a struck-by hazard while using a Tool and Hoist Specialties brand, 4-ton overhead crane (SN:J42818), that was missing a safety latch on the hoisting hook and had not been inspected at least annually. b. an employee was exposed to a struck-by hazard while using a Harrington 3-ton overhead crane (S/N unknown) that had not been inspected at least annually.
