29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics was not provided to the operator when the operator was involved in an accident or near-miss incident: a) Warehouse - On or about November 12, 2019, the employer did not ensure a forklift operator received refresher training before being allowed to re-operate a forklift after being involved in an incident where forks were not properly adjusted, which caused a tote on the forks to tip and spill the product. On or about February 27, 2020, the same operator was involved in another incident where a steel tote on a forklift being operated by the employee fell off and struck another employee, injuring the left arm.
