29 CFR 1926.1053(a)(1)(ii): Non-self-supporting portable ladder(s) were not capable of supporting without failure, at least four times the maximum intended load: a) 311 South Broad Street, Philadelphia, Pennsylvania - The employer did not ensure that all Michigan Ladder, Type 1A, used on the jobsite were capable of withstanding four times the weight of an employee, exposing an employee to fall hazards of approximately thirteen feet. An employee for the subcontractor suffered severe injuries when he fell from the ladder he was climbing in that a ladder rung supporting the employee broke free from the side rails of the ladder. Noted on or about 27 FEB 2020.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) 311 South Broad Street, Philadelphia, Pennsylvania - The employer allowed employees to use a 14 foot wooden Michigan Ladder, Type 1A, which did not extend at least 3 feet above the access level thus exposing employees to fall hazards. Observed on or about 27 FEB 2020.

29 CFR 1926.1053(b)(15): Ladders were not inspected by a competent person for visible defects on a periodic basis and after an occurrence that could affect their safe use: a) 311 South Broad Street, Philadelphia, Pennsylvania - The employer did not inspect and remove Michigan Ladder, Type 1A wooden ladders with compromised ladder rungs when using a wooden ladder to gain access to the upper floors of a new building construction project. An employee for the subcontractor suffered severe injuries when he fell from the ladder he was climbing in that a ladder rung supporting the employee broke free from the side rails of the ladder. Noted on or about 27 FEB 2020.
