29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided as necessary by reason of chemical hazards encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    a) Facility wide: Employees wore Tyvek 400 series lab coats or aprons or a yellow rain suit while repackaging nitric acid, acetic acid, hydroflouric acid, and sulfuric acid which were not adequate to prevent physical contact with the acids exposing the employees to burns, on or about March 16, 2020.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:    a) Facility wide: Employees voluntarily wore 3M half face elastometric respirator with acid gas cartridges and the employer did not have a written respiratory protection program and did not provide employees with medical evaluations, on or about March 16, 2020.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.138(b): The employer did not base selection of appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the tasks to be performed, conditions present, duration of use, and the hazards and potential hazards identified:    a) Facility wide: Employees wore Showa disposable latex gloves or Safety Zone blue latex gloves (GRCL) while repackaging sulfuric acid, nitric acid, acetic acid and hydrochloric acid which did not provide appropriate protection to prevent the exposure to chemical splashes and burns, on or about March 16, 2020.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    b) Operators Room: Employees, Operators, are exposed to chemical splashes to body, face and eyes by corrosive chemicals including, but not limited to, nitric acid, hydrofluoric acid, and acetic acid.  The portable eyewash unit in the room had expired in 2014 and one quart eye wash bottles maintained in the area would not supply an adequate flow of flushing fluid to the eyes, on or about March 16, 2020.      Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
