OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to fall hazards.   a. On or about March 16, 2020, located at 3945 Lewis Link (Lot 15) in New Albany, Ohio, employees were standing on the forks of a Skyjack, model number SJ1056 TH, rough-terrain forklift, to hand materials to an employee on the roof and to ascend and descend from the roof of a residential home exposing the employees to falls up to 14 feet and caught-between hazards.

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about March 16, 2020, located at 3945 Lewis Link (Lot 15) in New Albany, Ohio, the employer did not initiate and maintain safety and health programs for employees involved in wood framing activities, thereby exposing the employee to a various fall, struck-by and/or caught-between hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or about March 16, 2020, located at 3945 Lewis Link (Lot 15) in New Albany, Ohio, employees were installing sheathing on a steep-pitched residential roof without any means of fall protection, thereby exposing the employee to a fall hazard of approximately 14 to 20 feet.  b. On or about March 16, 2020, located on the second floor at a residential home at 3945 Lewis Link (Lot 15) in New Albany, Ohio, there were no top rails on six window openings, thereby exposing the employees to a fall hazard of approximately 16 feet.
