29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles. a) New residential construction, first floor : On or about 3/19/2020, and at times prior, the employer exposed employees to struck by hazards, in that protective safety glasses were not provided to employees while operating a Hitachi nail gun at 130 PSI conducting framing activities. The employees were wearing standard sunglasses.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) New residential construction, first floor : On or about 3/19/2020, and at times prior, the employer exposed employees to fall hazards, in that a fall protection system was not provided to employees while conducting framing activities from the first story top frame at a height of 11 feet 10 inches from the lower level.
