29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  A.) Danny Miller dba D&A Roofing, 201 West 26th Street, Erie, PA  16508, north side of the structure, on or about March 27, 2020 and times prior thereto:  Employees are performing work activities that include, but is not limited to, soffit work.  Employees are utilizing a roof jack scaffold during the work activities and are exposed to a fall hazard of 21.75-feet.  Employees are not utilizing fall protection when working from the roof jack scaffolding.  This ongoing violation was most recently observed on March 27, 2020.  To abate this ongoing violation, the employer must provide and require the use of fall protection when work more than 10-feet above a lower level.    ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.
