29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Estate Custom, LLC located at Scioto Landing, South Bloomfield, OH 43103:  On and preceding April 3, 2020, employees were performing water and storm system installation in several excavations ranging from 4'6" to greater than 6 feet deep without a protective system or egress in place nor was other PPE being utilized. The employer did not initiate and maintain safety and health programs related to the excavation work being conducted by employees.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Estate Custom, LLC located at Scioto Landing, South Bloomfield, OH 43103:  On and preceding April 3, 2020, the employer did not ensure employees wore hard hats while performing work inside of trenches around earth moving equipment.  Employees performing infrastructure work to include water and storm plumbing were working inside of trenches ranging from 4-feet to greater than 6 feet with loose materials including but not limited to dirt, rocks, tools and work materials overhead. No head protection was being worn by the employees which presented struck by hazards to the head.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) Estate Custom, LLC located at Scioto Landing, South Bloomfield, OH 43103:  On and preceding April 3, 2020, the employer did not ensure that a stairway, ladder, ramp or other safe means of egress was located in trenches where employees were working. Employees were performing water and storm plumbing installation in several excavations ranging from 4'6" to greater than 6 feet deep in sandy, fine soil.  The trenches did not have any means of egress available for the employees to safety exit in a timely manner.  The following condition exposed employees to struck-by/caught-in hazards.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  a) Estate Custom, LLC located at Scioto Landing, South Bloomfield, OH 43103:  On and preceding April 3, 2020, the employer did not ensure that protection was provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of trench. Employees were performing water and storm plumbing installation in several excavations ranging from 4'6" to greater than 6 feet deep with sections of the spoils on the edge of the trench near the area where work was being performed.  Materials on the edge of the trench included loose soil, rocks and large clumps of dirt. The following condition exposed employees to struck-by/caught-in hazards.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  a) Estate Custom, LLC located at Scioto Landing, South Bloomfield, OH 43103:  On and preceding April 3, 2020,  the competent person on site did not remove employees and make corrections to hazardous conditions to the trenches employees were working in. Employees were performing water and storm plumbing installation in several excavations ranging from 4'6" to greater than 6 feet deep in sandy, fine soil.  Sections of the spoils recently dug out were on the edge of the trench near the area where work was being performed and no protective system or an inadequate protective system in place. The soil was fine sand in most spots and visibly coming loose throughout the inspection.  The following condition exposed employees to struck-by/caught-in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a) Estate Custom, LLC located at Scioto Landing, South Bloomfield, OH 43103:  On and preceding April 3, 2020, the employer did not ensure that employees were protected from the hazard of cave-ins by an adequate protective system. Employees were performing water and storm plumbing installation in several excavations ranging from 4'6" to greater than 6 feet deep in sandy, fine soil.  The areas of the trench being worked had no protective system or an inadequate protective system in place. The soil was fine sand in most spots and visibly coming loose throughout the inspection.  The following condition exposed employees to struck-by/caught-in hazards.
