29 CFR  1926.652(g)(1)(ii): Shields were not installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads:   (a) Estate Custom, LLC located at or near  3451 Northup Ave, South Bloomfield, OH 43103: On and preceding December 14, 2021, the employer did not ensure that a trench shield was installed in a manner to restrict lateral movement.  A  4-5 feet gap  was between the trench shield walls and the face of the trench on both sides which exposed employees to a struck-by hazards in the event of lateral movement coming from a sudden shift in lateral loads.

29 CFR  1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    (a) Estate Custom, LLC located at or near 3451 Northup Ave, South Bloomfield, OH 43103: On and preceding December 14, 2021, the employer did not ensure a  portable ladder  used for access to an upper level landing surface extend at least 3 feet above the upper landing surface being accessed.   Employees used an extension ladder to enter/exit a trench which extended approximately 8 inches beyond the upper landing being, exposing employees to falls from heights up to 19 feet into the trench.

29 CFR  1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:   (a) Estate Custom, LLC located at or near 3451 Northup Ave, South Bloomfield, OH 43103: On and preceding December 14, 2021,  employees were performing water and storm system installation in an excavation that varied from 18 feet to 20 feet deep without a protective system or egress in place nor was other PPE being utilized. The employer did not initiate and maintain safety and health programs related to the excavation work being conducted by employees.  Estate Custom, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1499035 , citation number 2, item number 1 and was affirmed as a final order on March 30, 2021, with respect to a workplace located at 17 May Ave, ASHVILLE, OH 43103.  Estate Custom, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1471742 , citation number 1, item number 1 and was affirmed as a final order on June 22, 2020, with respect to a workplace located at Scioto Landing development, SOUTH BLOOMFIELD, OH 43103.

29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:   (a) Estate Custom, LLC located at or near 3451 Northup Ave, South Bloomfield, OH 43103: On and preceding December 14, 2021,  the employer did not ensure employees wore hard hats while performing work inside of trenches around earth moving equipment.  Employees performing infrastructure work to include water and storm plumbing were working inside of trenches ranging from 18 to 20 feet with loose materials including but not limited to dirt, rocks, tools and work materials overhead. No head protection was being worn by the employees which presented struck by hazards to the head.  Estate Custom, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.100(a), which was contained in OSHA inspection number 1471742 , citation number 1, item number 2 and was affirmed as a final order on June 22, 2020, with respect to a workplace located at Scioto Landing development, SOUTH BLOOMFIELD, OH 43103.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:   (a) Estate Custom, LLC located at or near 3451 Northup Ave, South Bloomfield, OH 43103: On and preceding December 14, 2021, the employer did not ensure that a stairway, ladder, ramp or other safe means of egress was located in a trench where an employee was working. An employee was performing water and storm plumbing installation in an excavation that was 18-20 feet deep working within a single 8' tall trench shield.  No means of egress was available for the employee to safety exit in a timely manner.  The following condition exposed employees to struck-by/caught-in hazards. An employee was performing water and storm plumbing installation in an excavation that was 18-20 feet deep working within a single 8' tall trench shield.  The soil was fine sand in most spots and visibly coming loose throughout the inspection.  The following condition exposed employees to struck-by/caught-in hazards.
