OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the biological hazards: a)Warehouse (Truck Unloading Area): On or about 3/19/2020, and at times prior, the employer exposed employees to biological hazards in that the employer did not ensure that appropriate administrative and engineering controls were used to protect against infective bat feces droplets while unloading truck and tagging merchandise with feces laying directly on the storage boxes or material.
